ISLAMABAD: The Supreme Court has issued an important decision regarding review petitions, making it clear that not every judicial decision can be allowed to be reopened. The verdict was heard by a bench comprising Justice Mansoor Ali Shah, Justice Muhammad Ali Mazhar and Justice Shahid Bilal Hassan.
The decision states that review is possible only if there is a clear legal or technical mistake in the decision. If a party does not like the decision, it cannot be a revision. The court also said that the arguments that were rejected in the first case were not acceptable to be revised.
The court expressed concern that millions of cases are pending across Pakistan and more than 56,000 cases are being heard in the Supreme Court alone, of which a large number of unnecessary review petitions are pending. The court said such cases are a waste of judicial time and should be discouraged.
On the other hand, today the Supreme Court is hearing review petitions regarding specific seats. These are the same seats on which the court ordered the representation of the PTI in July 2023. Review petitions have been filed against this decision.
The case will be heard by a full court of 13 judges, headed by Justice Syed Aminuddin Khan. Interestingly, Justice Mansoor Ali Shah, who wrote the original decision, is not part of the hearing this time.
