The Supreme Court, while accepting the intra-court appeals, has reinstated the NAB amendments, nullifying the decision of the three-member bench

The Supreme Court allowed the government’s intra-court appeal and reinstated the NAB amendments. The court annulled the decision of the 3-member bench.

The 5-member bench of the Supreme Court, headed by Chief Justice Qazi Faiz Isa, restored the NAB amendments by pronouncing the decision of the NAB amendments case as 5 zero.

On behalf of Chief Justice Qazi Faiz Isa, while pronouncing the verdict on the NAB amendments case, it was said that PTI founder Imran Khan could not prove that the NAB amendments are unconstitutional.

Justice Athar Manullah and Justice Hasan Azhar Rizvi also wrote additional notes, Justice Athar Manullah rejected the intra-court appeal of the federal government, and Justice Athar Manullah agreed with the majority decision.

The judgment said that the decision of the 3-member bench could not prove that the NAB amendments were against the constitution, the government filed 2 intra-court appeals and the affected parties, Zoheer Ahmed and Zahid Imran filed intra-court appeals as the affected parties. were filed.

The court said that the Supreme Court should try to uphold the legislation whenever possible, the court noted that the Supreme Court cannot play the role of gatekeeper for the Parliament, the Chief Justice and judges cannot be the gatekeeper for the Parliament, the court said that The detailed decision will be released on the website of the Supreme Court.

A 5-member larger bench headed by the Chief Justice had reserved the verdict on June 6, Justice Aminuddin, Justice Jamal Mandukhel, Justice Athar Manullah, and Justice Hasan Azhar Rizvi were part of the bench.

It should be noted that the NAB amendments were approved during the PDM regime. Amendments were made in sections 2, 4, 5, 6, 14, 15, 21, 23, 25 and 26 of the NAB rules. Against the NAB amendments, PTI founder Imran Khan filed a petition in the Supreme Court. A 3-member bench headed by former Chief Justice Umar Atta Bandyal had reserved the judgment in the case on September 5, 2023.

On September 15, 2023, the Supreme Court granted the petition of the founder of PTI and declared the NAB amendments invalid. The Supreme Court had invalidated 9 of the 10 amendments of the NAB amendments.

Federal and provincial governments had filed intra-court appeals in the Supreme Court against the Supreme Court’s decision.
